The Food and Drug Administration is investigating whether a state lawmaker has ordered the federal government to reimburse the state of Arizona for erectile dysfunction drugs, including Viagra.

“The drug industry is spending millions on drugs for which it has no prescription and has no legal authority,” state Sen. Mia Khalil (D-San Diego), who is running for president, told NBC News.
Khalil said that since the drug industry is spending $3 billion a year on erectile dysfunction drugs, it would be “increasing the total expenditure in the state.”
The state lawmaker is running an investigation into the drugs.
Khalil’s bill, which would allow the state to reimburse the state for erectile dysfunction drugs, would be the first bill the federal government has introduced in the state.
The FDA said it had not received any reports of an increase in the number of drugs the state would reimburse the federal government, but that it had been unable to determine how many drugs it would reimburse the state.
“Our investigation continues to show that this is an increase in the number of prescriptions that the state must provide,” the FDA said in a statement.
An FDA spokesman, Dr. Sidney Wolfe, did not return a message left for NBC News.
Federal Health Services Secretary Michael Pearson told NBC News that the number of drugs the state would reimburse the federal government would have increased by an additional 10 percent over the next six months.
“If it’s true, it would be an increase in the number of prescriptions that the state must provide,” he said.
The drugmakers who purchased Viagra in 2010, according to the FDA, had spent $5.2 billion on Viagra, a year that the FDA said had led to more than $2 billion in annual sales.
VIAGRA has been prescribed to millions of men since its launch last September, according to the agency.
Viagra, which is sold under the brand name Sildenafil, was approved by the FDA in 1998.
It has been prescribed to about 3 million patients since its launch.
The drug is sold under the brand name Revatio, which was approved by the FDA in 2002.
The FDA said the agency was unable to determine whether the drug is safe and effective in treating patients with erectile dysfunction.
“The agency is disappointed with the results of this investigation and is looking at other options, including other approved medications,” the FDA said in a statement.
The drug companies also have been accused of marketing Viagra to millions of patients as part of an effort to expand the availability of prescription drugs.
“In response to the increasing demand for Viagra, the company has launched various promotions, which have led to increased sales,” the FDA said.
The FDA said it had not received any reports of an increase in the number of prescriptions the state would reimburse the federal government, but that it had been unable to determine how many drugs it would reimburse the state.
The agency’s findings are part of a larger study conducted by the nonprofit group Public Citizen in June that found that Viagra was not as effective as some other PDE5 inhibitors, such as the painkiller Vioxx, that were used to treat heart conditions.
The study, published in the August 2007 issue of the journal, analyzed data from over 3,000 patients who took Viagra for at least four months and a similar number for patients who took another PDE5 inhibitor for at least six months.
The researchers found that patients taking Viagra reported significantly fewer erections, compared to patients who took sildenafil, in the first year of treatment.
“In the second year of treatment, the overall rate of sexual arousal was significantly lower in patients taking Viagra, compared to patients who took sildenafil,” the researchers wrote.

Pfizer has a new drug for erectile dysfunction called Viagra, the company said in a regulatory filing.
The U. S. Food and Drug Administration approved Viagra in the United States in late September. Pfizer's drug is the first approved for erectile dysfunction by the agency.
The drug, marketed as a treatment for erectile dysfunction in men, treats men with the condition known as benign prostatic hyperplasia (BPH). BPH can be a symptom of other conditions like diabetes, high blood pressure, high cholesterol or an enlarged prostate.
"We are pleased to inform you that we have received the FDA's approval of Viagra for sale in the United States," said Dr. John suessler, Pfizer's U. sales and marketing director. "Pfizer's Viagra has been shown to significantly improve the symptoms and quality of life for some patients with BPH."
The FDA's approval follows an 18-week clinical trial conducted by Pfizer Inc., showing a significant improvement in the ability to achieve and maintain erections.
Pfizer also announced a $2.5 million grant to help cover expenses for the trial, which will cover a total of $250 million. The drug is available only with a prescription from a licensed physician.
Pfizer will have a three-month supply of Viagra on hand in the U. at the end of September.
In addition to the FDA approval, Pfizer also announced that it will be marketing a generic version of the drug, which is called VIAGRA, for $4.50 to $5 per dose. VIAGRA is available in the United States through a manufacturer's discount program. generic drug was launched in May.
The FDA's approval of the drug is expected to be in response to the launch of VIAGRA by Pfizer.
